How overtime is worked out

Under the federal Fair Labor Standards Act, most hourly workers earn 1.5 times their regular rate for hours over 40 in a workweek. A workweek is a fixed 168 hours that your employer sets.

California adds a daily rule. Hours over 8 in a day are overtime, hours over 12 are double time, and the seventh day in a row has its own rule. HoursOwl applies daily rules first, then the weekly 40.

Are breaks counted as work?

Short rest breaks are paid time. Meal breaks of 30 minutes or more are usually unpaid when you are fully relieved of duty. Set the break above to match your employer.

Why does my stub differ from this estimate?

Common reasons are a different workweek start, rounding rules, shift pay differences and unpaid breaks. Use Check my stub to see which line moves.

Do salaried workers get overtime?

Many are exempt, but only when they meet salary and duties tests. A job title alone does not decide it.
